ปัจจุบันการขนส่งสินค้าทางเรือ
“โดยระบบ Container”
(สินค้าบรรจุใส่ตู้คอนเทนเนอร์)
เป็นที่นิยมอย่างมาก

UCP 600 sub-article 20 (c)
ระบุไว้ว่า….
A bill of lading indicating that transhipment will or may take place is acceptable, even if the credit prohibits transhipment, if the goods have been shipped in a container…… as evidenced by the bill of lading.

ดังนั้น..
แม้ว่า Field43T จะระบุว่า
“Not Allowed”

การถ่ายลำเรือ ก็สามารถทำได้

เนื่องจากกฎข้อนี้ ระบุไว้ว่า…
แม้ L/C จะสั่งห้ามถ่ายลำเรือ
แต่หากปรากฎข้อมูลบน B/L ว่า
เป็นการขนส่งสินค้าโดยระบบ Container….
B/L ที่ระบุว่า “จะ” หรือ “อาจจะ” มีการถ่ายลำเรือ
(เช่น B/L ระบุว่า Transhipment by Vessel V2)
ก็ยอมรับได้

แต่หาก L/C ระบุว่าให้ยกเว้นกฎดังกล่าว
เช่น ระบุว่า “UCP 600 sub-article 20 (c)
is excluded”
(และ Field 43T ระบุว่า Not Allowed)
อย่างนี้ก็จะไม่สามารถถ่ายลำเรือได้
