ของแต่ละเอกสารที่ระบุใน field 46A กัน

ผมอยากแนะนำให้รู้จักกับ ISBP กันก่อนครับ
ISBP ย่อมาจาก
International Standard Banking Practice
แปลว่า วิธีปฎิบัติของธนาคารที่เป็นมาตรฐานสากล
(ในการตรวจเอกสารภายใต้ UCP 600) อ่านเพิ่มเติม “ISBP 745”
Field 46A “Document Required”
“Document Required” หมายถึง
เอกสารที่ถูกร้องขอ
[ที่ผู้รับประโยชน์ (Beneficiary)
ต้องนำมายื่น (ส่งมอบ) ให้ธนาคาร
เพื่อขึ้นเงินตาม L/C (เรียกเก็บเงินค่าสินค้า)] อ่านเพิ่มเติม “Document Required”
Field 45A “Description of Goods and/or Services”
รายละเอียดเกี่ยวกับสินค้าที่ตกลงซื้อ-ขาย
จะถูกระบุใน Field นี้ เช่น
ชื่อสินค้า, จำนวน, ราคาต่อหน่วย,
Incoterms เป็นต้น
ซึ่งปกติก็จะตรงกับใน Proforma Invoice (P/I) นั่นแหละครับ (แต่ก็ไม่เสมอไปนะครับ เช่น
ชื่อสินค้า บางครั้งก็อาจแตกต่างไปบ้าง
ด้วยเหตุผลบางประการ แต่ผมขอพูดในกรณีที่สมมุติว่าตรงกันก่อนนะครับ) อ่านเพิ่มเติม “Description of Goods and/or Services”
Field 44C : Latest date of shipment
หมายถึง สินค้าส่งได้ช้าสุดภายในวันที่ๆระบุนี้
(หากส่งช้าไปกว่านี้ ถือว่าผิดเงื่อนไข)
(รูปแบบคือ yymmdd)
เช่น ใน Field 44C ระบุว่า
100815 ก็แปลว่า สินค้าส่งได้ช้าสุดภายใน
วันที่ 15 เดือน 8 ปี 2010
เรื่องนี้เกี่ยวข้องกับ
1) เอกสารที่แสดง date of shipment
2) ความหมายของคำว่า date of shipment อ่านเพิ่มเติม “Latest date of shipment”
Field 44E “Port of Loading / Airport of Departure” และ
Field 44F “Port of Discharge / Airport of Destination”
ผมจะยังคงพูดถึง
“การขนส่งสินค้าระหว่างประเทศ
ทางทะเลโดยเรือ” นะครับ
2 Field นี้ จะถูกใช้คู่กันกรณีที่เป็น
Port-to-Port shipment
ก็คือ กรณีการจัดส่งสินค้าจาก
ท่าเรือต้นทาง (Port of Loading) ไปยัง ท่าเรือปลายทาง (Port of discharge) นั่นเอง
ดังนั้นเอกสารการขนส่ง (ในกรณีนี้คือ B/L)
จะยังคงต้องเป็นไปตาม Article 20 ของ กฎ UCP 600
มาคุยเรื่อง Transhipment กันต่อครับ
ปัจจุบันการขนส่งสินค้าทางเรือ
“โดยระบบ Container”
(สินค้าบรรจุใส่ตู้คอนเทนเนอร์)
เป็นที่นิยมอย่างมาก
UCP 600 sub-article 20 (c)
ระบุไว้ว่า….
A bill of lading indicating that transhipment will or may take place is acceptable, even if the credit prohibits transhipment, if the goods have been shipped in a container…… as evidenced by the bill of lading.
ในที่นี้ผมจะขอพูดถึงกรณีการ
ขนส่งสินค้าระหว่างประเทศทางทะเล โดยเรือ จากท่าเรือต้นทางไปยังท่าเรือปลายทาง
“Port-to-Port shipment”
เท่านั้นนะครับ
จะยังไม่พูดถึงการขนส่งรูปแบบอื่นๆ
เอกสารการขนส่งสำหรับกรณีนี้
(Port-to-Port shipment) จะต้องเป็นไปตาม Article 20 ของ กฎ UCP 600
วันนี้มาต่อส่วนที่สองกันครับ

ส่วนที่สองระบุว่า…..
“A presentation consists of one or more sets of transport documents evidencing shipment on more than one means of conveyance within the same mode of transport will be regarded as covering a partial shipment, even if the means of conveyance leave on the same day for the same destination.”
หมายความว่า…..
มาคุยเรื่อง Partial Shipment กันต่อครับ
UCP 600 ระบุว่า…..
“A presentation consisting of more than one set of transport document evidencing shipment commencing on the same means of conveyance and for the same journey, provided they indicate the same destination, will not be regarded as covering a partial shipment, even if they indicate different dates of shipment or different ports of loading, place of taking in charge or dispatch. If the presentation consists of more than one set of transport document, the latest date of shipment as evidenced on any set of transport documents will be regarded as the date of shipment.
A presentation consists of one or more sets of transport documents evidencing shipment on more than one means of conveyance within the same mode of transport will be regarded as covering a partial shipment, even if the means of conveyance leave on the same day for the same destination.”

Field นี้จะใช้สำหรับระบุว่า
“Allowed” หรือ “Not Allowed”
หมายความว่าการ Partial Shipment นั้น “ได้รับความยินยอม” หรือ “ไม่ได้รับความยินยอม”
